Buganda Road Court has Monday dismissed cyber harassment and offensive communication cases against Brian Isiko in which it is alleged that he sent love messages to Kabarole Woman MP, Sylvia Rwabwogo.
Brian Isiko, 25, a student of YMCA College of Business Studies in Jinja, was facing charges of cyber harassment and offensive communication against Ms Rwabwogo.
However, when the case come up today for hearing and cross examination of Ms Rwabwogo, magistrate Stella Amabilisi dismissed the case for lack of prosecution witnesses.
Court argued that it was unfair for Isiko to keep reporting back to court yet the complainant has never appeared to testify even when she was summoned on four occasions.
Amabilisi ruled that from 2018, the witness [Rwabwogo] has never appeared in court yet the accused has been appearing.
“This shows that the witness is not interested in the matter,” ruled Amabilisi.
She added: “In the interest of justice, the case has been dismissed and the accused is set free unless charged with other offences. Bail money should be refunded.”
Isiko’s lawyer Ramathan Waiswa said record reflects that court had ordered the witness to be in court and the court had said that failure to appear, the case would be dismissed.
In July 2018, Isiko pleaded guilty for the November 2017 and June 2018 love requests, suggestions or proposals which were obscene, rude, lustful or indecent to the person of Rwabwogo.
He was sentenced him to two years in jail. He then appealed in the High Court and the judgement was quashed and a retrial ordered.
